Italian citizenship by descent
(iure sanguinis)

Italian Citizenship by Descent (Iure Sanguinis) for Descendants of Italian Immigrants in the United States
For over 150 years, millions of Italians have brought their talent, culture, and families to the United States. If you have an Italian ancestor who emigrated to the USA — whether in the 1880s or the 1950s — you most likely already qualify for Italian citizenship by blood (iure sanguinis).
Current Italian Citizenship Law (updated 2025)
Italian citizenship is passed down through bloodline with no generational limit, governed by:
• Law No. 555 of 13 June 1912 (as amended)
• Law No. 91 of 5 February 1992
• Ministry of the Interior Circulars K.28 series, especially K.28.1 of 8 April 1991
Until December 27, 2024, the primary route was applying through Italian Consulates in the United States.
Following Decree-Law No. 209 of 27 December 2024 (converted with amendments into Law No. 23 of 24 February 2025), new restrictions were introduced:
• Strict generational limits now apply for individuals born abroad after 1948
• All “1948 cases” (descent through a female ancestor who gave birth before January 1, 1948) now require judicial proceedings
For these reasons, the fastest, safest, and most definitive path to Italian citizenship today is through the Italian courts.
Why thousands of Italian-Americans now choose the judicial route
• Predictable timeline: court decision in 10–18 months (vs. 8–14 years average wait at U.S. consulates)
• No generational limits and no restrictions on maternal lines
• One single case covers the entire family nucleus (parents, children, siblings)
• Immediate eligibility for an Italian passport upon the court’s ruling

• Legge 13 giugno 1912, n. 555 (e successive modifiche)
• Legge 5 febbraio 1992, n. 91
